Counter Notification

Choice of Law & Forum; Statute of Limitations

You agree that the Legal Stuff shall be governed by the internal substantive laws of the State of New York, without reference to its conflict of laws principles. Any claim or dispute between you and SusanPowterOnline.com that arises in whole or in part from your use of SusanPowterOnline.com shall be decided exclusively by a court of competent jurisdiction located in New York County, New York.

YOU AND SUSANPOWTERONLINE.COM AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO SUSANPOWTERONLINE.COM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Waiver

No waiver of any of the Legal Stuff shall be deemed a further or continuing waiver of such term or any other term, and SusanPowterOnline.com’s failure to assert any right or provision under the Legal Stuff shall not constitute a waiver of such right or provision.

Severability & Integration
